Terms and Conditions of Use

Welcome to HomeCrew Network and its affiliated platforms, including but not limited to: BrooklinNeatCo.ca, EastBrookCleanTeam.ca, UxCleanHomeServices.ca, TauntonSparkle.com, and EvergleamCleaning.com ("we", "us", "our", or "Platform").

These Terms and Conditions ("Terms") govern your access to and use of our websites, mobile applications, and other services (collectively, the "Platform"), including any interaction with independent cleaning service providers ("Service Providers") facilitated by us.

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree, do not access or use the Platform.

1. Nature of the Platform

HomeCrew Network is a neutral online platform that facilitates connections between individuals or entities seeking residential cleaning services ("Clients" or "You") and independent third-party cleaners ("Service Providers").

We do not own, employ, or supervise any Service Provider. We do not directly offer cleaning services of any kind.

Our role is strictly limited to providing a platform where Clients can request services and be matched with available Service Providers. We make no representations or warranties about the quality, timing, legality, suitability, or reliability of any Service Provider or their services.

2. No Employment or Agency Relationship

Service Providers are independent contractors who operate independently and are not employees, agents, representatives, or affiliates of HomeCrew Network.

We do not:

• Control or direct how Service Providers perform services
• Provide training or tools for cleaning
• Guarantee availability or completion of any booking

You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you and HomeCrew Network as a result of these Terms or your use of the Platform.

3. Insurance Disclaimer

HomeCrew Network does not provide any insurance coverage to Clients or Service Providers.

We do not carry liability, property, or workers' compensation insurance for any services facilitated through the Platform.

It is your sole responsibility to assess and ensure any insurance needs are addressed directly with the Service Provider or through your own coverage. By using our Platform, you acknowledge and accept full responsibility for any risks, losses, or damages that may arise from services rendered.

4. Limitation of Liability

To the fullest extent permitted by law, HomeCrew Network and its officers, directors, employees, contractors, agents, affiliates, and licensors shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including but not limited to:

• Injury to person or property
• Loss of profits or revenue
• Service dissatisfaction or incomplete work
• Theft, damages, or misconduct by a Service Provider
• Delays, no-shows, or miscommunication

We expressly disclaim any responsibility for any disputes, damages, or losses arising from your interactions or transactions with Service Providers. Any claims, legal or otherwise, must be pursued directly with the Service Provider.

5. User Responsibilities

By using the Platform, you agree to:

• Provide accurate and truthful information during service requests
• Communicate clearly and thoroughly with your assigned Service Provider
• Ensure that your premises are safe, accessible, and prepared for the scheduled service
• Not engage in any illegal, abusive, or discriminatory behavior with respect to the Service Provider or Platform

You understand that we do not guarantee service quality or outcome, and that any dispute, dissatisfaction, or service issue must be resolved between you and the Service Provider directly.

6. No Warranty

The Platform and all related content, features, and functionality are provided "as is" and "as available" without any warranties of any kind, either express or implied, including:

• Fitness for a particular purpose
• Merchantability
• Accuracy, availability, or error-free operation

We do not guarantee uninterrupted access, availability of Service Providers, or specific service outcomes.

7. Dispute Resolution

HomeCrew Network is not a party to any service agreement between the Client and the Service Provider. We do not offer dispute resolution services.

Any disputes, complaints, or legal claims must be resolved privately between the Client and Service Provider. By using this Platform, you waive any right to involve HomeCrew Network in such matters.

8. Indemnification

You agree to defend, indemnify, and hold harmless HomeCrew Network and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the Platform
• Your interaction with a Service Provider
• Any violation of these Terms
• Any injury, damage, or loss caused by your conduct or that of a Service Provider booked through the Platform

9. Modifications and Termination

We may update or modify these Terms at any time, at our sole discretion. We will attempt to notify users of significant changes, but continued use of the Platform after changes constitutes your acceptance of the revised Terms.

We also reserve the right to suspend or terminate access to the Platform for any user, at any time, without notice, for violations of these Terms or for any other reason.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles.

You agree that any legal proceedings arising out of or related to your use of the Platform shall be filed exclusively in the courts of Ontario, Canada.
